This online store is operated by Luna-canada, trading as Avery and Charles ("Avery and Charles", "we", "our", "us"). Together with all related content, products and services, we refer to it as the "Services".

Our store runs on the e-commerce platform of Shopify Inc., which hosts our website and supports us in providing the Services.

In this Privacy Policy we describe which personal information we collect, why we collect it, how we use and protect it, and which rights you have under Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and, where it applies, Québec's Act respecting the protection of personal information in the private sector. By visiting our website or placing an order, you confirm that you have read and understood this policy.

1. What information we collect

Depending on how you interact with our store, we may collect:

Identity and contact information: your name, email address, telephone number, billing address and shipping address.
Payment information: card details, payment confirmations and transaction records, processed through our payment providers. We never see or store full card numbers.
Account information: login details, password, saved preferences and settings.
Purchase information: products you view, add to your cart, buy or return.

Support information: the content of the emails or messages you send to our customer service, including any attachments.

3. Who we share your information with

We share personal information only when necessary, with:

Shopify Inc., which hosts our store and processes orders on our behalf,
payment providers and delivery partners, so that payments can be completed and parcels can reach you,
service providers for IT, analytics, advertising and email, which support the operation of our store,
public authorities or courts, where we are legally required to do so.

All partners are contractually required to protect your information and to use it only for the agreed purpose.

4. Consent, marketing and advertising

We collect, use and disclose personal information with your consent, except where the law allows otherwise. You can withdraw your consent at any time, subject to legal or contractual restrictions; if you do, we may not be able to complete an order or provide part of the Services, and we will tell you so.

We send commercial emails only with your consent, in line with Canada's Anti-Spam Legislation, and every such email contains an unsubscribe link. We do not sell your personal information. Like most online stores we use advertising and analytics services (for example Google) that may receive information about your visit through cookies or tags. You can block or delete cookies in your browser settings, and you can opt out of the use of your information for interest based advertising by emailing info@averyandcharles.com.

5. Shopify

Because our store is built on Shopify, Shopify also collects and processes certain information (such as cookies and device information) to run the platform and provide analytics. 6. Where your information is handled

We are based in Netherlands. Your information is stored and processed outside your province, including on servers in the United States, Canada or the European Union operated by Shopify and our service providers. While it is held there, it may be accessed by the courts, law enforcement and national security authorities of those countries under their laws. Wherever it is handled, it is protected under this policy and the contracts we have with those providers.

7. How long we keep your information

We keep personal information only for as long as necessary. In practice this means we keep it:

to fulfill your orders and provide the Services,
to meet legal and tax obligations,
to resolve any disputes, and
to enforce our agreements.

When information is no longer needed, it is securely deleted or anonymized.

8. Your rights

Under Canadian privacy law you have the right to:

access the personal information we hold about you and receive a copy of it,
have inaccurate or incomplete information corrected,
withdraw your consent to the use of your information, subject to legal and contractual limits,
in Québec, ask us to stop disseminating your information or to de-index it, and receive computerized information you provided to us in a structured, commonly used technological format.

We respond within 30 days, and if the law allows us more time we tell you so within that period. If you are not satisfied with our answer, you can file a complaint with the Office of the Privacy Commissioner of Canada (priv.gc.ca) or, in Québec, with the Commission d'accès à l'information (cai.gouv.qc.ca).

10. Do Not Track

Our website does not currently respond to browser Do Not Track signals. Third parties such as Shopify and our analytics and advertising providers may collect information about your activity on our website over time; we do not direct them to collect it across other websites on our behalf.

11. How we protect your information

We take appropriate technical and organizational measures to keep your personal information secure. At the same time, no online system can ever be completely secure, so we cannot promise absolute protection of information transmitted over the internet.

If a breach of security safeguards involving your information creates a real risk of significant harm, we notify you and the Office of the Privacy Commissioner of Canada (and, in Québec, the Commission d'accès à l'information) as the law requires.

12. Children

Our Services are not directed at persons under 18. We do not knowingly collect personal information from children under 14 without the consent of a parent or guardian. If you believe a child has provided us with personal information, contact us so we can remove it.

13. Changes to this policy

We may revise this Privacy Policy from time to time, for example when our activities or the legal requirements change. The most recent version is always published on this page with an updated "Last updated" date. If the changes are significant, we will say so clearly on our website.
